Chapter 12: General and special jurisdictions and public prosecution
This chapter summarizes current constitutional design regarding general and special jurisdictions as well as public prosecutions. It is based on the review of national constitutions and seeks to establish a common ground for writing and amending constitutions. It evaluates the establishment of courts and distribution of competences amongst the judiciary. Further, it review the appointment process of judges, their nomination and participatory bodies, including the High Council of Judges. Further factors are the independence of judges and the budget of the judiciary. Finally, the structural approach to the public prosecution in a constitution is discussed. This chapter forms part of Vol. I of Writing Constitutions.
